An Act Respecting First Nations, Inuit and Métis children, youth and families came into force on January 1, 2020. It provides communities with the mechanism to exercise their inherent jurisdiction over the care of their own children and families in accordance with their own traditional laws and values. It also sets out national minimum standards which apply to all agencies providing child and family services for Indigenous children.
Community child and family service laws can be recognized by the federal government as federal law and given priority over provincial child and family services laws, should we decide to participate in a Coordination (negotiation) table.
Upper Nicola Band applied for and received capacity funding to explore jurisdiction: It is important for us to understand your interest regarding jurisdiction, developing our own laws and working with the Government of Canada and B.C. to gain a funding agreement to support the implementation of our law and the organization that will take over managing our relations (children and families). Over the next year, we will be asking you for input on the needs of our Relations (children, youth, and families) to ensure that the programs developed are reflective of the needs of the whole community. We will also be asking you to participate in the process of law development. Your participation is appreciated.
